three courts of appeal...ontario, bc, and quebec have ruled that the law is unconstitutional.... all on absolutely solid legal grounds.

while other courts are not strictly bound per se, other lower courts would find their authority 'persuasive'

any jurisdiction that challenged the law would in all likelyhood lose.

even in alberta.
