I'd blame the photographer as much as the model poacher - you send a girl to a set there should be no other agent on the premises while she is there.

Rico had a legal exclusive services contract with the girl and wanted to sue but in the end he decided not to go through with it. Litigation is expensive and stressful so he decided to just move on.
