I'd blame the photographer as much as the model poacher - you send a girl to a set there should be no other agent on the premises while she is there.
Mutt, it's impossible to police that and unrealistic to think that a producer, photographer or anyone can prevent a model from speaking to other models or agents in the course of their work and possibly getting tempted to seek new opportunities elsewhere. If your friend spent $40k to build a whole site around a model and if he insisted on exclusivity then the only plausible way to try to enforce that exclusivity would be with an exclusive services contract, just like Vivid themselves uses. If he didn't bother getting her to sign a contract like that then he was foolish to fail to do so. If he *did* get her to sign a contract like that then he was foolish not to hire one of the savvy industry attorney's to bring action against Vivid for tortious interference or whatever other strategies the attorney might devise.
