I don't know for sure, but I believe that doubke jeopardy also covers lesser included crimes. So if a prosecutor can't, for instance, make a case for murder 1, but they could for murder 2, then the charge would be murder 2. Otherwise they could just keep pressing charges one after the other starting at the worst and working their way down. That wouldn't be fair.
