there is no safe harbor for deleting videos there is only a safe hrbor against copyright infringement claims
nothing else is safe harbored
so of course you can't lose safe harbor for something that doesn'[t have a safe harbor in the first place
but that the point
the liablity for the takedwon is transfered FROM the host to the copyrright holder only if the takedown notice is sent.
so taking shit down without a takedown notice increase the liablity from zero (because the copyright holder takes it instead) to something (because it can't be transfered to anyone)
i suggest you hire a real lawyer because your talking out of your ass
or maybe actually read the law your talking about.
