as i pointed out dmca safe harbor doesn't give immunity for taking down content it only gives transactional immunity for infringing. the liability for a false takedown is only transfered to the person making the takedown notice.
if youtube was to take down the videos without getting a notice there would be no one to transfer the liablity to, and therefore it would be on their shoulders.
