My brother saw the surgeon this morning and is scheduled for surgery at 7:00 AM tomorrow. The surgeon told him that due to the type of injury...surgery may or may not be helpful but he would attempt to improve upon the injury. Bottom line he is going to have a fucked up knee for the rest of his life. He is 26.
I got a copy of the Police report today and even though the driver of the car admits being at fault and was in violation, he too is at fault as he was in the wrong bike lane so he too was in violation. I will see his attorney on Tuesday and provide him with the Police report and I will learn how this will affect the case. I would assume that damges will be negated.
