What was being "sold" were pre-paid ad spots. Money is changing hands one way or another and I think the laws are starting to catch up with what's going on.

If you notice they don't go after dvd released movies on torrents... It's the new releases that haven't been releases or are still in theaters. Those are DRM protected movies, recording them is a crime, uploading them is another crime - screw copyright infringement, people do go to jail for doing this.
If a person buys ads from a site doing the above, they are assisting in criminal activity and both parties will be put in jail, fined, etc - and sites taken down.
