The only reason I would ask a lawyer about releasing his name is if I didn't have proof.
If they don't have proof that an employee did it then they shouldn't blame it
on an employee at all at this point.
Just say "we were compromised and are still investigating it".
If they are worried about the employee suing them for making it public then
they should also worry about getting sued for making it known in-house also, since
the other employees are going to discredit this person on any job they move on to.
In other words : Whispering in your ear that somebody sucks does not protect me
if it's not true and you run out and spread the news yourself.
I would simply be sued for whispering the untrue stuff to begin with.
