That is not necessarily true. You need to know if they went to trail with ALL the charges. The best way to explain this is if a guy killed 4 people the State/Feds will go to trail on the first 2 and if they fail, then reintroduce other charges ie., being the second 2 murdered people. According to "these facts" and these facts only,(not some random fact pattern that you think up) they did go to trial and he was "acquitted" of all charges. Thus the "Double Jeopardy" rule will apply. If it were a mistrial then they would be able to retry the case.
