We do attempt that first. About 99% of the time the emails on the contact info go to a black hole and there is no contact. The escalation to the DMCA process takes it to the host level which is where people seem to get in contact with us. Unfortunately the DMCA process doesn't allow us to include a request to become an affiliate on the DMCA notice to the host and processors. A lot of people who run celebrity sites don't want to be found, and it's near impossible for us to make contact prior to it getting to the DMCA level.

I would certainly prefer to have that one on one contact up front. No one wants to be a bully, especially when what we're finding is people are being told things that are false, and are actually victims themselves.

In some cases we have been able to get real contact with the site owners, and that has been beneficial.

Thanks for that, that's a great point and something we do make every attempt to do before DMCAing.
