It doesn't matter if other domains are available under the trademark ...

Lots of people have registered domains under trademarks they didn't own and lost those domains ...

Both ICANN and the courts have ruled that the trademark holder almost always owns it ... not you ...

So, if he decides to litigate/arbitrate and prevails ...

You may not only incur attorneys fees yourself but have to pay his as well.

There's always a small chance that you might prevail, but the odds are against you ...

Why go through the hassle?

I didn't follow the Bruce Springsteen case ...

But Madonna got her domain back ... as have many others.
