Frequently, by doing something you create in "in effect" duty. For example, if you walk past a lake and see someone drowning, the legally smart thing to do is to keep walking. Why? You have no legal duty to help (amazing, but true). However, once you start trying to help, you are opening yourself to all kinds of lawsuits.
By legal parallel, if you as a secondary producer start keeping recards it is actually the primary producer's duty to keep, and you blow it here or there, all of a sudden questions arise as to why you blew it.
Better to keep the duties where they belong.
