That depends upon where you are and state laws.

In some states it is completely legal...the idea is that if someone speaks to you about something they are in essence giving you the right to do with that information how you see fit.

It's not like they didn't want you to know about it.

However, if you were to ask a 3rd party or a 3rd party decided to do so (barring law enforcement who has a proper warrant) to record the conversation that's an entirely different situation.

Now regarding discrimination when renting to you.

Local apartment boards they can't really do shit. You need to go to HUD.
