The law doesn't say anything about jail time for spamming. The law says that if you spam with forged headers or use hacked boxes, or if you make software that does the aforementioned, or if you employ a minor to do the aforementioned things, you can go to jail.
As long as you're not hiding who you are, you're free to spam to your hearts content.
