So let me get this straight. Summary for those who skipped pages:

1) Smart affiliate signs up with a program, checks the TOS, realises with glee they don't disallow PPC campaigns using and branded / copywritten phrases, sets up some campaigns, starts earning, it's all good.

2) Program owner doesn't notice, hasn't set up his terms and conditions properly to include something that he obviously detests and doesn't understand fully.

3) Program owner checks up to see where the sales are coming from, and realises he's an imbecile for not including the no bidding on specified keywords in his ToS.

4) Rather than updating ToS and paying affiliate, decides to keep this and other affiliates money, and goes on a 10 day cruise, ignoring 1300 posts from active Webmasters in the largest adult webmaster community on the planet telling him to pay up, and thinks this is smart business sense?
