You can't copyright a concept! The code is subject to copyright, the graphics are subject to copyright, the text is subject to copyright. The concept/idea is NOT.
Choker may or may not be able to argue that his concept is original. But if you want to protect a concept, in general you need to patent it. Since there is no patent, you're fairly safe copying it.
As for legal proof, that can be found anywhere...
including -- believe it or not -- GFY!
