Calif law is even worse.

I am having a contractor add on to my house. We had to sign a mechanics lien to him in case we failed to pay. I totally agree with that and we have paid all but the last 5000 due upon completation of his work. That's cool.

Anyway, I got a preliminary notice in the mail from the lumber yard the other day that the CONTRACTOR has an OPEN account with saying that the LUMBER business can put a lien against my house if the contractor fails to pay his bill.. This is per some civil code section..

Total bull since the contractor has an OPEN account.. It's amazing that a law allows the lumber yard to go after the owner of the house who did not apply for the open credit account or has the lumber bill ....If the contractor failed to pay, I would have to prove that I had paid him the money..


Good thing he is someone I know and can trust... ( knock on wood )
