But I am sure you are aware that in some cases (if not most) that the person who owns the site is the one that is going out stealing the content and filling up the site himself.
There is no DMCA protection for the sites "members", just the site owner.
Now DMCA proects the site from the action of it's "members" if there is a REAL member doing it. However DMCA does not protect the member. The member is still doing something illegal and is liable.
I can't wait till one of these companies sues the site's members for stealing the content and then the site is hit with a subpoena for all of the information for the "members" who posted the stolen content. My bet would be that the site wouldn't be able to turn over any info because chances are it was the site itself stealing the content and pretending their "members" did it. If that was proved then the site would be fucked and would be a slam dunk lawsuit that they would lose.
Why hasn't one of these companies who's content is always getting stolen by the same site do this yet?
