Nope .... You will need to send a DMCA with proof that YOU own the content, without any doubt. Till then, your C&D will be used as paper napkins.


On the other hand, if a hosting company decides, in respect to his own business plan , to terminate that account, he will have to do it accordingly to his TOS.
