Well, tell it to the judge, then. Torrenting copyrighted material is a violation of copyright law, unless you have express written permission. If they leaked it, they won't pursue you. If they didn't leak it, they could (and should).
And you don't really know which is the case, do you? You're acting on assumptions. In absence of confirmation from Showtime, it SHOULD be assumed that it's stealing, so how 'bout you quit jumping down people's throats around here who DON'T like copyright stealers?
