More and more adult websites do not have the warning these days given that it is clear on the very first page what the site is about.
I know some ISP's and countries may require an warning page so you may want to check with your local state attorney as well as with your national government and of course the ISP.
As for a privacy policy, I have only run across an issue with mainstream websites where we wanted to link with larger fortune 500 companies.
I would think though that if you run a mix site where you have mainstream content as well as adult content, then you probably will want the warning page so that the kids who are on your site understand what is going on.
