You can't sue someone for deleting your site when you give them access to your server.
If your host who has access by default deletes your sites for no reason you might be able to have some sort of case.
If someone hacks into your server and deletes your sites, you definitely have a case.
When a guy who has no need for access to your server deletes your sites and you gave him access, you have nothing.
