That's something usually only found in strangulation deaths.

When you see the guy's feet "whale tailing" in the air that is probably due to
the choke which is killing him. At that point he is not kicking at anyone but
having convulsion instead.
So he is probably unconscious at that point but a highly
trained city cop will interpret convulsions as resisting arrest and continue choking and beating.
