Yeah, but we're not talking about dealing with a fence, we're talking about a dealing with a facilitator

In this case, there was most certainly some back-and-forth communication between the end customer and the actual designer re design modifications and such. And, by necessity, the middleman filled the role of messenger. Under these circumstances, the customer was not at all out of line in assuming that he paid the correct party. Moreover, I think it's a pretty safe bet that (in the beginning at least) the actual designer thought it was going to play out like that as well.

Now, it's just a question of who gets left holding the bag.
