TMM is very lucky that NJ doesnt have Anti-SLAPP legislation or this could have been a very risky situation....
For those that dont know what Anti-SLAPP is, here is a short description from of all places Wikipedia....

To win an anti-SLAPP motion, the defendant must first show that the lawsuit is based on constitutionally protected activity. The filing of an anti-SLAPP motion stays all discovery. I really dont know the facts of this situation, but at least here in California as soon as someone threatens a suit over free speech, they have to realize that there is a potential Anti-SLAPP motion coming.
