currently it not, the court ruled that 1 download = 1 lost sale arguement is not valid.

since the workprint is never sold. none of the downloads translate into a lost sale
ergo no economic loss
ergo it complys with the 4 requirements of fair use.
it still a grey area because the supreme court has not upheld the lower court ruling yet, however currently the law is on downloaders side of the transaction
