The British/US soldiers had their choice - either kill innocent people or refuse to follow orders and go to jail, the Nazis werent so lucky - back then it was either follow orders or get shot.

Yes but were Nazi soldiers ever charged simply for being Nazi soldiers? I'm pretty sure the people that were charged with war crimes were charged for more than just fighting in the German army.
