What about Warez-bb.org, Forumw.org, planetsuzy.org, barfland.com. All forums with tons of traffic, I don't see much downtime from them at all. Have you personally complained to a host they used and as a result it was taken down? How many times has it been taken down, once or twice, for a day, half a day? You think the hosts are oblivious to what's going on with these high traffic sites until a complaint is made?

They do? How do you know they actually run the site? Just because they are moderators isn't evidence that they run or have ownership of the site. Again, where is this stolen content hosted again? On their physical server?

Oh, but it does. Those same disclaimers protect many sites from losing in court against companies or person(s) claiming copyright infringement. Even Yahoo and Google groups where users post links to outside sites that may have stolen content have the exact same type of disclaimers.
If I started a thread here on GFY with stolen content, does that mean GFY is liable? If Google's search engine spiders a list of rapidshare links filled with stolen content, are they liable? This is exactly the reason piratebay has just recently had ALL copyright infringement charges against them dropped.
