The problem is no actual hosted content is on their site! It's just a collection of links posted by users, their disclaimer protects them from legal action. It would be like trying to send google a DMCA for allowing pirated content to be displayed within their search results. They will simply claim that they have no control over what is shown. There are so many known warez forums that do this, and trust me legal action has been brought against virtually all of them with no results.
Eventually, rapidshare, megaupload and all the big file sharing networks will be stopped. That is the key to stopping communities that share stolen content. Rapidshare has been dragged into court before, however little came of it due to disclaimers which protect them. Their angle is that the files hosted on their servers are the responsibility of the user who uploads them.
