For instance you have paid for a membership and agreed to the license the owner or licensee of the content allows you. In most cases you have paid for a months membership to a site. I rarely see a site that "Sells" a specific number of set/videos. For instance on CCBILL I see it says 30 days for $29.95. Nothing about 500 videos for $29.95.

actually it all the videos on my site for 30 days.
Which is exactly like all the tv shows on the cable for 30 days.
timeshifting the show to a time outside that 30 day window is legal for the cable tv example
therefore it is legal for the membership site.
The key is what videos were you licienced a right to view DURING that 30 day window.

another false analogy because the my use of the bed DENIES someone else from using it. This the problem with theft/physical goods analogy.
Look at it this way
you sell me the right to view for money (licience)
you give me the content for free
I will always own the right to view.
getting the content from an alternative source fullfil that right to view is legal.

which is exactly the point of the private tracker (to compete)
or liciencing it for bit torrent distribution (to legitimize the distribution)
or live with the exploitation of the fair use.

the constitution is not the only law that could make this law illegal,
anti trust law could blunt or invalid portions
as well as international treaties like the berne convention.

Anarchy on the Internet is not a solution. It will cost too much money. Allowing sites to cripple billion dollar industries, throw people out of work by stealing or promoting theft and all to make a few million is not a solution. The West needs the money being lost to get back to where it should be.

i am arguing for the status quo, the current laws are good enough.
Business solutions working within the scope of the current laws solve all the problems WITHOUT extending the monopoly power of copyright beyond its intended scope.
