My purchase of 4 was OEM from a retail shopfront. It's possible the "new" drives were damaged somewhere between Seagate's factory and my hot little hands, but don't forget that some of the replacement drives shipped from Seagate (in their approved packaging) also went faulty.
I switched over to WD, 2 failures so far, but I use a fair few HDs and that's a much, much better record than Seagate.
