Granting your members and only your members the right to use torrents as a fair use access tool (backup recovery timeshifting) would allow you to get rid of all the other torrents out there legally.

The point you seem to be making is that because some people are using the torrents for illegitimate purposes, (caused by your refuse to fulfill your members fair use right to the content) you should have a right to stop everyone from using it (including those who are using it for legal uses).
