Actually, they do still have the books, and you're actually well within your right to scan all of them and keep... It's called "fair use", look it up. The legal problems only start when you start selling those copies to others because THAT becomes copyright infringement. It does not in any way become "theft" and no one has ever been prosecuted or convicted of "theft" in relation to any of this... maybe you should actually take a minute and acquaint yourself with the issues surrounding copyright?
