If he set up the deal and handed the thief the keys then he is part of the crime.
Pirate bay sets up the deal by giving you the ability to go to their site and search for the torrents. They then hand the thief the keys by allowing them to download the torrent.
pirate Bay is hosting the torrent files.. They are handing out the keys for the thief's to steal the products.. With out the torrent files no one can download a torrent.
