That was my first thought after reading the news article.
McDonalds has little choice other than fighting this in court, no matter how much it costs, because if they don't, zillions of other people will try doing scams centered around purposedly leaving cell phones, usb sticks, cameras, etc in McDs restaurants.
On a related note, many establishments provide WiFi service, which, to me, seems very legally risky ... because many of them do
not post disclaimers / warnings that such data may intercepted by others.
