It's obviously a loop hole. It's also obvious that "user uploaded" sometimes, if not most often, means that the tube site themselves are doing it. You could buy a trial membership at any major sponsor, and have your outsourced worker ripping and uploading movies and it would hardly cost anything at all.
That's the problem. Either DMCA needs to be changed, or google needs to lose to Viacom over youtube. Until then, it's kind of tricky.

ok but if you have already asked them to take it down once and more gets uploaded dont you have ground to do something more?
