No, you don't have to shoot for it to be assault.

Also, is the nephew on probation or parole? Good info to have when you DO file that police report. You ARE going to file a report, right? If hes on probation or parole, he can be searched at any time. That includes any residence he may live in.


That's a loose cannon you're living next to. What happens if you're not around with your 9mm the next time he loses it on a loved one?
