if they would have hit them... like in any other similar case in teh US, the parents would have found some ambulance chasing attorney assholes and sued the railroad, engineer, state, city and anyone else they possibly could... and they would probably win.
did you know every state has a whole body of law based on slipping on grapes in super markets?
