I never noticed they oversold their bandwidth. I have noticed that various peering points are sometimes conjested. When we pumped 2 gigs through my lines it worked fine.

Look at the economics. It is straightforward to lay out fiber and hook up transceivers. It is quite hard to bargain with competitors for peering when they themselves are vying for transport business.
