How can you do #1 and #2 without gathering the surfer's info?
You're either going to have to sue the tube site, to get the log files, so you can identify the users who uploaded so that you can then sue them. OR
You're going to set up a fake tube site, and track users who upload files, and then sue them for doing so.
Either way, once word gets out that porn sites are tracking their surfers and you can possibly be sued for downloading/uploading the wrong file, (publicity is what you're after here to scare the surfers...that's what you said) then the 80% of porn surfers who surf "in the closet" will never come back.
May end up being a boon for the DVD and magazine in plain brown wrapper business though.

The problem here is that you people think it's the surfers fucking you over on the tube sites....it's the SITE OWNERS, THE WEBMASTERS, who are uploading the content in order to attract surfers.
You think a guy opened up a site with no content and asked surfers to come fill it up for him?
