I know, I agree with that. I was just saying that resisting and protecting yourself might appear the same to police in some situations...
I can see how some people end up getting their asses kicked very badly because 1 or 2 "move your ass" blows caused them to cover up... putting the cop into a situation where he thinks the person is resisting and has to be more aggressive.
This card can be played very well by defense lawyers, etc... the cop was just doing his job, etc.
But some people might really not want to resist but can't help it because they're getting the shit kicked out of them.
