Here is what bothers me most about his case. It isn't the content. I think you can take 12 people from just about anywhere, show them Max's stuff and they may find it obscene. It is not for everyone, including me, but I think he should be allowed to produce it.
That said the real problem is that some of the convictions were for movie trailers that are on his website. This means that that a group of jurors from bum-fucked nowhere in Florida have now decided what can and cannot be seen on the internet. That isn't right. I am sure I can find a community somewhere in the US that thinks artistic nude pictures or things that are very tame like Playboy are obscene and now this case could open up the door to those types of prosecutions. If you put it on the web someone somewhere might be offended by it and they can drag you into court wherever that may be. That isn't right. The internet is a paid for service that has tons of filtering options on it. If you go online, unfiltered and find something you think is obscene you brought that on yourself you asked for full access and you got it. This case, if allowed to stand, could open up the gate and provide established case law and that is disturbing.
