I think you are confusing the Communications Decency Act (which was overturned by the Supreme Court in 1996 or 1997) with the newer Child Online Protection Act. The Child Online Protection Act is still making its way through the courts. The Supreme Court sent it back to the appeals court last year. Now the appeals court has said that it is unconstitutional. This is an important ruling.
