Yes.
First of all that is indeed the law in most states.
Secondly, if the two cars in your example are both going the same fucking speed than why the bloody hell do they need two lanes to do so?

In a manner of speaking, yes.
The
passing lane is for
passing regardless of how fast (or slow) you're going. If you're not in the process of passing another vehicle, than you belong in one of the cruising (i.e. "slow") lanes.
It's really that simple.
