JustDaveXxx also keep in mind with the Evil Angel case they are glossing over obscene and Miller. It is already presumed to be obscene and that is not up for debate to the jury. It is about website trailers as well as very old school telecommunications laws to transport obscene material across state lines.
They are just asked if the trailer is viewable across state lines and if the material is accessible across state lines and if so does it apply to them. I.E. it is already presumed and will be listed as obscene to the jury as the obscenity is not really in question. Also at issue is allowing access to minors via the web, which was already struck down but oh well.
Then once again Miller is thrown out as a trailer counts as its own "whole". Which would never apply to say an excerpt from the Kinsley report now would it?
The whole case is beyond fubar and Max's case just adds a little more fire to the hearings specially with the venue of EA's trial which is full of people who would fight tooth and nail to keep those tel-co laws in place.
Yet carry on, they will never go after less rough stuff. They will never target anyone doing regular porn. This is not calculated and they also fired assorted DA's for lack of zeal to go versus obscenity and they also added extra funding and hire more people for shits and giggles.
