Once you sell the item you no longer have it. You also only have ONE of that item. HUGE difference than buying a CD or DVD making a copy( or 2 or 500 ), sell it and still having one for yourself to enjoy.

In this particular case, no. They were linking DIRECTLY to the actual files first of all. Put it this way if you tell someone where they can buy drugs even though you didn't actually sell the drugs you can in fact be busted for helping facilitate a drug sale.
