Okay, I'm not reading the whole thing ... so when did he find out he had to sit on the toilet?
If before flight, and he boarded anyhow, then he's a pylon with a much weaker case.
If during flight, he simply should have refused citing regulations (that are surely public knowledge) against it ... and then the lawsuit is probably his, though $2M is ludicrous.
