I'm inclined to agree with this. Some basic design elements are shared (oval shape, gradient, thumbnails, rounded buttons, right-hand "feature bar") but you can't seriously be claiming that any of those were original on the first site, either. Scroll through the portfolio of any major designer or sponsor and you'll see dozens of sites like that.
The webeinc is design is nicer, anyway. I don't think a less-good copy hurts the original any. There's plenty of people who try to paint like Van Gogh but it doesn't stop his painting from fetching astronomical prices. People know good work when they see it. Besides, the sites don't share content, theme or even a common language.
