Let me ask you this, lets say a surfer is surfing your site and finds a pretty amusing photo that you posted and decided to save the file and upload to their own server so to pass it along to some buddies.... Is this really stealing? I am not privy to how all of this went down but I do know that Marco is not a thief nor is he a looser.
